Terms of Use

Last updated 2 August 2026. These terms are the agreement between you and PandaTour360, which runs PandaTour 360 from Poland. They cover the website, the editor and every tour published with it. How we handle personal data is a separate document — the Privacy Policy.

Agreement

By creating an account, subscribing to a plan, or opening a tour published with PandaTour 360, you accept these terms. If you do not accept them, do not use the service. If you are agreeing on behalf of a company, you confirm you are allowed to bind it, and “you” means that company.

The Privacy Policy forms part of this agreement. Where the two documents overlap, the Privacy Policy governs personal data and these terms govern everything else.

The service

PandaTour 360 turns 360° photographs into a virtual tour. You upload equirectangular panoramas, join them with link and info hotspots, add a floor plan and a logo, and publish. The result is a URL that opens in any modern browser, with no account and nothing to install, and can be embedded in your own site with an iframe.

The service is offered on a free plan and on paid plans. The current plans, prices and limits live on the pricing page and that page is the authoritative version. We may add, change or withdraw features; if a change materially reduces what a paid plan includes, we will tell subscribers before it takes effect.

Eligibility

You must be at least 16 years old to hold an account. PandaTour 360 is a tool for businesses and is not directed at children.

You may not use the service if you are subject to sanctions, or located in a country under an embargo, that would make providing it to you unlawful.

Your account

Register with details that are accurate and keep them current. You may sign up with an email address and password or with “Continue with Google”. Either way, the credentials are yours to protect: everything done through your account is treated as done by you.

One account is one customer. Do not share logins across a team when what you actually need is a bigger plan, and do not open several accounts to work around the limits of a smaller one. Tell us at info@pandatour360.com as soon as you suspect someone else has access.

Acceptable use

You agree not to use PandaTour 360 to:

  • publish anything unlawful, or any photograph of a place or a person you have no right to publish;
  • publish sexual content involving minors, or material that promotes violence, terrorism or hatred against a group;
  • infringe someone else’s copyright, trade marks or privacy — including panoramas you did not shoot and are not licensed to use;
  • impersonate another business, or present a tour in a way designed to mislead about what a property is or who is selling it;
  • send malware, phishing pages or spam through hotspots, links or the enquiry form;
  • scrape, crawl or bulk-download the service, or resell access to it as if it were your own product;
  • bypass plan limits, rate limits or authentication, reverse engineer the software, or probe it for vulnerabilities without our written permission;
  • interfere with the service or with anyone else’s use of it, including by loading it in a way designed to degrade it.

If you find a security flaw, report it to info@pandatour360.com rather than exploiting it. We will not pursue anyone who reports in good faith and gives us a reasonable chance to fix it.

Your content

Your panoramas, floor plans, logos, titles and descriptions remain yours. Uploading them gives us nothing but the permission we need to run the service: a non-exclusive, worldwide, royalty-free licence to store, process, resize, generate previews from, and transmit that content — to you in the editor, and to visitors of the tours you publish.

That licence exists only to operate PandaTour 360 and ends when you delete the content or the account, subject to backups rolling over on their own schedule. We do not sell your content, we do not use it to train machine-learning models, and we will not put your tour in our showcase or any marketing without asking you first.

You are responsible for having the rights to what you upload and for keeping your own copies. PandaTour 360 is a publishing tool, not an archive.

Published tours and their visitors

Publishing a tour makes its link public. The link is unlisted, not secret: anyone who has it can open the tour, and anyone can pass it on. Unpublishing stops the link working immediately, including for people who already had it.

On paid plans a tour can collect enquiries — name, email, phone, message — from visitors. Those enquiries are yours and so are the data-protection duties attached to them; see the Privacy Policy, §1 and §2. The ?leads=0 link parameter hides the form from visitors but is not a server-side block; ask us if you need it genuinely disabled.

Tours published on plans below Studio carry a PandaTour 360 mark. Removing, hiding or obscuring it is a breach of these terms — replacing it with your own logo is what the Studio plan is for.

What a tour is not

A tour is a set of photographs joined together. PandaTour 360 does not build a 3D model of a building, does not measure anything, and produces no floor areas, dimensions or survey data. Lenses distort, stitching bends straight lines, and a panorama flatters a room.

Do not rely on a tour — and do not let your clients rely on one — for measurements, valuations, structural condition, or any decision that would normally need a surveyor, an inspection or a physical visit. You are responsible for the accuracy of what you publish and for disclosing staging, editing or the age of the photographs where the law or your profession requires it.

Third-party services

PandaTour 360 runs on services we do not control. They process data on our instructions, but their own terms govern their performance, and we are not responsible for their acts or outages beyond our own obligations under §15 and §16.

Paid plans and billing

Paid plans are subscriptions billed in advance, monthly or yearly, through Stripe. Yearly billing is 20% cheaper per month and is charged as one payment for the year. Prices are in US dollars; taxes are added at checkout where they apply. We never see or store your card details.

A subscription renews automatically at the end of each period until you cancel. Cancel any time in the billing portal: the plan stays active until the end of the period you have already paid for, and then drops to the free plan. We do not refund part-used periods, and payments already taken are non-refundable except where the law says otherwise. If a payment fails and stays unpaid, the subscription ends and the account moves to the free plan.

Moving down a plan deletes nothing. Tours beyond the free plan’s limit are unpublished until you free up a slot or move back up, and paid-only features stop working while you are not on a paid plan. We may change prices with at least 30 days’ notice before the change applies to your next renewal.

Feedback

If you send us an idea, a bug report or a suggestion, we may use it without restriction, payment or credit. Feedback is not confidential and does not create any obligation on our part to build anything.

Intellectual property

The PandaTour 360 software, website, design, name and logo belong to the operator of PandaTour360. These terms grant you a limited, revocable, non-transferable right to use the service — nothing in them transfers ownership of anything. Your content (§6) is not covered by this section; it stays yours.

Force majeure

Neither party is liable for failing to perform because of something outside its reasonable control — network and hosting failures, power cuts, natural disasters, war, strikes, or acts of government. Payment obligations already due are not excused.

Termination

You can stop at any time: cancel the subscription in the billing portal, or delete the account outright. Deleting the account deletes your tours, scenes, hotspots and the enquiries stored under them, and unpublished tours stop resolving straight away.

We may suspend or close an account that breaches these terms, that has not paid, or that we are required by law to stop serving. For anything short of serious or unlawful breach we will warn you first and give you a reasonable chance to put it right; for illegal content, fraud, or activity that endangers the service or its users, suspension is immediate. Sections 6, 11, 12 and 15 to 18 survive termination.

Disclaimer of warranties

The service is provided “as is” and “as available”. To the extent the law allows, we make no warranty that it will be uninterrupted, error-free, or fit for a particular purpose, and none that a tour will look identical on every device or in every browser. We do not warrant that storage is permanent — keep your own copies of your panoramas.

Limitation of liability

To the extent the law allows, we are not liable for indirect or consequential loss, for lost profits, lost business, lost sales, or for the cost of re-shooting panoramas you did not keep a copy of.

Our total liability arising out of or in connection with the service is limited to the greater of the amount you paid us in the twelve months before the claim arose and USD 50. Nothing here excludes liability that cannot lawfully be excluded — including death or personal injury caused by negligence, fraud, and the statutory rights of consumers.

Indemnity

If someone brings a claim against us because of what you published — a photograph you had no right to use, a tour that misled a buyer, an enquiry you handled unlawfully — or because you broke these terms, you will cover the resulting claims, damages and reasonable legal costs. We will tell you promptly about any such claim and let you take part in its defence.

Governing law

These terms are governed by the law of Poland, and the Polish courts have jurisdiction over any dispute. If you are a consumer in the EU or the UK, this does not deprive you of the protection of your local mandatory law or of your right to bring proceedings in your own courts.

Changes to these terms

When these terms change we update the date at the top, and for anything material we tell account holders by email before it takes effect. Continuing to use PandaTour 360 after that means you accept the new version; if you do not, cancel and stop using the service.

For a copyright notice, identify the work, the tour link that carries it, and your grounds — we act on notices that are specific enough to check. Email is the channel for legal notices; if a matter needs a postal address, ask and we will give you one. Everything else is on our contact page.
